1. Acceptance of Terms
By accessing or using NameFirst.ai, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
2. Description of Service
NameFirst.ai is an AI-powered creative identity platform that helps users generate brand names, product names, AI character profiles, character portraits, and other creative visual assets. NameFirst.ai is an independent product and is not affiliated with Anthropic, Meta, Google, or any AI model provider.
3. Ownership of Generated Content
All brand names, product names, character profiles, generated images, and other creative content generated through the service belong to you. You are free to use, trademark, or commercialize any content generated during your sessions.
AI-generated content, including character portraits, profiles, and other visual assets, are original creations produced by AI models. NameFirst.ai does not claim any copyright over your generated content. You are solely responsible for how you use, distribute, or publish generated content.
By using the service, you grant NameFirst.ai a limited, non-exclusive license to process your inputs solely for the purpose of providing the service.
4. No Trademark Guarantee
NameFirst.ai does not guarantee that any generated name is available for trademark registration, free from third-party rights, or suitable for commercial use. You are solely responsible for conducting your own trademark searches and legal due diligence before adopting any name.
5. AI Disclaimer
NameFirst.ai uses large language models (LLMs) and AI image generation models to produce naming suggestions, character profiles, character portraits, logos, and other creative assets. AI-generated content may occasionally be inaccurate, inappropriate, or similar to existing works. We are not liable for any consequences arising from the use of AI-generated content.
All generated content is intended to be safe for work (SFW). We do not support or condone the generation of NSFW, illegal, or harmful content. We reserve the right to refuse service or revoke access for users who attempt to generate prohibited content.
NameFirst.ai is an independent product and is not affiliated with, endorsed by, or sponsored by Anthropic, Meta, Google, Black Forest Labs, fal.ai, or any AI model provider. The underlying AI providers and models may change over time.
6. Intellectual Property and DMCA
AI-generated characters are original creations. However, AI models may occasionally produce content that resembles existing copyrighted characters or intellectual property. If you believe any content generated on NameFirst.ai infringes your copyright, please contact us at hi@namefirst.ai with the following information:
- A description of the copyrighted work you claim has been infringed
- The URL or identifier of the infringing content on our platform
- Your contact information and a statement of good faith
We will review all takedown requests promptly and remove infringing content where appropriate.
7. Payment, Credits, and Refunds
Paid plans are processed by Creem, our Merchant of Record. All prices are in USD and inclusive of applicable taxes where required by law.
7.1 Credits System
NameFirst.ai uses a credits-based billing system. Credits are consumed dynamically based on actual AI usage. Different quality modes and features (naming sessions, character creation, image generation) consume different amounts of credits.
7.2 Credit Packages and Entitlements
Each credit package includes the credits themselves plus additional entitlements:
- Free (15 credits/day): Lite mode only, up to 5 names per forge. Daily credits reset at midnight UTC and do not accumulate.
- Spark (100 credits): Unlocks Lite + Smart modes, up to 8 names per forge.
- Plus (500 credits): Unlocks all modes (Lite, Smart, Expert), up to 10 names per forge.
- Pro (2,000 credits): Unlocks all modes, up to 15 names per forge, plus early access to beta features.
Once a credit package is purchased, the associated entitlements (mode access, names per forge) remain permanently unlocked, even after credits are used up. Purchased credits never expire.
7.3 Credits Terms
Credits are virtual units of service usage. Credits are non-transferable, non-exchangeable for cash, and may not be resold. Credits have no monetary value outside of the NameFirst.ai platform.
7.4 Refunds
Refund requests must be submitted within 7 days of purchase by contacting hi@namefirst.ai. Refunds are granted at our discretion. Credits that have been partially or fully consumed are not eligible for refund.
8. Acceptable Use
You agree not to use NameFirst.ai to:
- Generate content intended to harass, defame, or harm others
- Generate NSFW, sexually explicit, or violent content
- Generate content that infringes on third-party intellectual property rights
- Violate any applicable laws or regulations
- Attempt to reverse-engineer or extract AI models or system prompts
- Resell or redistribute access to the service without permission
9. Service Availability
We aim to provide a reliable service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by law, NameFirst.ai shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of profits or data.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent court in the jurisdiction where the service operator is located.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or a notice on the website.
