1. Acceptance of Terms

By accessing or using NameFirst.ai, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

NameFirst.ai is an AI-powered naming platform that helps users generate brand names, product names, and other creative names through a conversational interface. NameFirst.ai is an independent product and is not affiliated with Anthropic, Meta, or Google.

3. Ownership of Generated Content

All brand names, product names, and other creative content generated through your naming sessions belong to you. You are free to use, trademark, or commercialize any names generated during your session.

By using the service, you grant NameFirst.ai a limited, non-exclusive license to process your inputs solely for the purpose of providing the naming service.

4. No Trademark Guarantee

NameFirst.ai does not guarantee that any generated name is available for trademark registration, free from third-party rights, or suitable for commercial use. You are solely responsible for conducting your own trademark searches and legal due diligence before adopting any name.

5. AI Disclaimer

NameFirst.ai uses large language models (LLMs) to generate naming suggestions. AI-generated content may occasionally be inaccurate, inappropriate, or similar to existing names. We are not liable for any consequences arising from the use of AI-generated content.

NameFirst.ai is an independent product and is not affiliated with, endorsed by, or sponsored by Anthropic, Meta, Google, or any AI model provider. NameFirst.ai uses third-party AI models to provide naming suggestions. The underlying AI providers may change over time.

6. Payment, Credits, and Refunds

Paid plans are processed by Creem, our Merchant of Record. All prices are in USD and inclusive of applicable taxes where required by law.

6.1 Credits System

NameFirst.ai uses a credits-based billing system. Credits are consumed dynamically based on actual AI usage during naming sessions. Different AI quality modes consume different amounts of credits per session.

6.2 Credit Packages and Entitlements

Each credit package includes the credits themselves plus additional entitlements:

  • Free (15 credits/day): Lite mode only, up to 5 names per forge. Daily credits reset at midnight UTC and do not accumulate.
  • Spark (100 credits): Unlocks Lite + Smart modes, up to 8 names per forge.
  • Plus (500 credits): Unlocks all modes (Lite, Smart, Expert), up to 10 names per forge.
  • Pro (2,000 credits): Unlocks all modes, up to 15 names per forge, plus early access to beta features.

Once a credit package is purchased, the associated entitlements (mode access, names per forge) remain permanently unlocked, even after credits are used up. Purchased credits never expire.

6.3 Credits Terms

Credits are virtual units of service usage. Credits are non-transferable, non-exchangeable for cash, and may not be resold. Credits have no monetary value outside of the NameFirst.ai platform.

6.4 Refunds

Refund requests must be submitted within 7 days of purchase by contacting hi@namefirst.ai. Refunds are granted at our discretion. Credits that have been partially or fully consumed are not eligible for refund.

7. Acceptable Use

You agree not to use NameFirst.ai to:

  • Generate names intended to harass, defame, or harm others
  • Violate any applicable laws or regulations
  • Attempt to reverse-engineer or extract AI models or system prompts
  • Resell or redistribute access to the service without permission

8. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, NameFirst.ai shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of profits or data.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent court in the jurisdiction where the service operator is located.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or a notice on the website.
